    Chestnut is a British slang term for an old joke, often as old chestnut . The term is also used for a piece of music in the repertoire that has grown stale or hackneyed with too much repetition. Twentieth Century Fox Corp. 1939 4 D.L.R. 353 is a leading Judicial Committee of the Privy Council opinion on copyright law . The Council held that copyright cannot subsist in non original work or in the title of a work alone unless it is original and distinctive. Francis, Day and Hunter had released a song titled The man who broke the bank at Monte Carlo . Years later, 20th Century Fox put out a movie by the same title, but had no other connections to the song. Francis sued for copyright infringement. Lord Wright held that a name alone cannot possess copyright unless it is sufficiently original and distinctive. To break the bank is a hackneyed expression, and Monte Carlo is or was the most obvious place at which that achievement or accident might take place. The son of an architect , he himself adopted that profession, and it appears that he commenced late in life to apply to literary pursuits. Pursuing his studies at Rome , he had the honor of teaching Bentivoglio , and acquired the friendship of the cardinals Gaetano and Borghesi, as well as of other distinguished personages. By their influence he obtained posts, and was appointed by Gregory XIII governor of Benevento in the Papal States states of the church . Here, however, he seems to have acted imprudently, and he was soon recalled to Rome, where he shortly afterwards composed his most important work, the Ragguagli di Parnaso News sheet from Parnassus , in which Apollo is represented as receiving the complaints of all who present themselves, and distributing justice according to the merits of each particular case. The book is light and fantastic satire on the actions and writings of his eminent contemporaries, and some of its happier hits are among the hackneyed felicities of literature. To escape, it is said, from the hostility of those whom his shafts had wounded, he returned to Venice , and there, according to the register in the parochial church of Santa Maria Formosa , died of colic accompanied with fever on November 16, 1613. The first edition was published in 1955 by Simon and Schuster , four years after Kerr had begun work as a theater critic for the New York Herald Tribune . His book is an examination of what Kerr perceived were various negative trends and flaws in playwriting. Kerr s tone is at various points jocular, learned and lucid, with humorous titles, clear prose and an evident wide knowledge of playwrights from the Greek literature Greeks all the way to Arthur Miller and other playwrights of the mid 20th century. Of moderate length 244 pages , the book takes on many themes and topics. Kerr offers insights both into the practice and finances of contemporary theatre, blaming the declining audience declining even in 1955 on the poor and un entertaining fare being put before the public by both commercial and institutional producers. In particular, he blames decades of slavish imitation of Henrik Ibsen and Anton Chekhov , not only because their styles had become hackneyed and arthritic Ibsen, himself, had abandoned Ibsenism after only a decade , but because they were created by and for an intelligentsia, and no thriving theatrical culture has ever been built that way, citing the case of William Shakespeare vs. the school of John Lyly , among others.     Crazy Sunday is a short story by F. Scott Fitzgerald originally published in American Mercury on October 1932. Plot The story centers on a young screenwriter , Joel Coles, as he comes to terms with his personal and professional failures. Coles is already 28 and has not yet distinguished himself. Moreover, the material he has been working on is trite and hackneyed. During the course of the story Coles becomes involved with a high profile couple, Miles and Stella Calman. Coles sees Calman at the studio lot during the course of many weeks, but most of their interaction occurs on Sundays. Coles who is an alcoholic is soon invited to a party thrown by the couple. He promises himself he won t drink but soon imbibes. During this party he performs for the audience and subsequently falls flat. Humiliated, he writes a letter to the host, Miles Calman. Calman s wife, whom Coles knew when she lived in NY, is described as near an emotional bursting point. Calman has been cheating on her for some time, and Crazy Sunday opens with him doing this. Stella intends to stay faithful to him but confides in Joel she feels she must cheat on him to balance the scales. Calman also confides in Joel that he is frantic over losing Stella. At the close of the story Joel a self described hack has not developed professionally nor personally from his associations with Hollywood. However, he manages to have sex with Stella one Sunday night when Miles is away on business. Afterwards, Joel basks in the glory of his conquest, and pours himself a drink. The phone rings and Stella answers it. She is informed Miles has died in a plane crash.
