Facts Ms Johnston was made redundant when her fixed term contract was not renewed. Women were prohibited from carrying firearms. But many police duties involved carrying firearms. The RoyalUlsterConstabulary argued the ban was justified because 1 they may be more frequent assassination targets 2 their guns could end in enemy hands 3 the public would object to it 4 it would hinder their jobs in social, family and children related work. Judgment The European Court of Justice held it was up to the Industrial Tribunal to determine whether art 2 2 now art 14 applied having regard to the specific duties which Ms Johnston is required to carry out Referring to article 2 2 of the Directive, it should be observed that that provision, being a derogation from an individual right laid down in the directive must be interpreted strictly. However, looking at the context it cannot be excluded that there would be more risks if policewomen carried firearms. So that may be a determining factor, and if so the member state can place a restriction, which need periodic review under art 9 2 . There must also be proportionality so derogations remain within the limits of what is appropriate and necessary for achieving the aim in view and requires the principle of equal treatment . Facts Ms Shamoon was a chief inspector. She did appraisals of the constables in the Urban Traffic Branch. Her appraisal duties were removed from her after complaints were made about the way she did them. She was dismissed and made a claim under the Sex Discrimination Northern Ireland Order 1976, which is the same as the SDA 1975 , and now found in the Equality Act 2010 . The Employment Tribunal held that there was sex discrimination. It said that the appropriate comparators were two male chief inspectors who were in the same branch and had the same duties, in which they continued, but who had not had complaints against them. The Northern Ireland Court of Appeal held that her claim failed because the two comparators she pointed to who had done similar appraisals had had no complaints made against them. Judgment The House of Lords held that the comparators were inappropriate because there had been no complaints about them. Lord Hope agreed that the comparators were inappropriate. The RoyalUlster Academy RUA has existed in one form or another since 1879. It started life then, as The Belfast Ramblers Sketching Club . In 1890 it became The Belfast Art Society later in 1930 it was changed to The Ulster Academy of Arts and Sir John Lavery was elected its first President finally, in 1950 King George VI conferred the title, The RoyalUlster Academy of Arts , upon the institution. Today the RoyalUlster Academy of Arts RUA is a flourishing artists organization. Many of Ireland s most distinguished artists are exhibiting members of the Academy. The Constabulary can trace its history back to 1686 when the Royal Navy needed an organisation to prevent dockyard crime . So the Secretary to the Admiralty Samuel Pepys , the diarist formed a force of porters, rounders, warders and watchmen to guard the Naval Yards. Porters identified and escorted visitors, rounders patrolled the yard, warders were responsible for the keys and backed up the porters at the gates, and the part time watchmen guarded buildings and areas by night. In 1834 this force became the first dockyard police, with full police powers within the dockyards, and acting as policemen over offences committed by employees and Naval personnel within a radius of five miles of the yard. Rewards for obtaining convictions quickly led to corruption, so the force was cleaned up and then abolished. The Metropolitan Police took over, and senior Naval officers became magistrates. A Royal Marine Police Force was formed 1934 and subsequent changes led in 1949 to the Admiralty Constabulary being created. The Ministry of Defence Police absorbed the AC in 1971, along with the Army Department Constabulary and the Air Force Department Constabulary . Berkshire Constabulary is a former Home Office police force which was responsible for policing the county of Berkshire in Southern England . Berkshire Constabulary was merged with several other adjacent police forces in 1968 to form the Thames Valley Police . Formed in 1856, the Constabulary was headquartered near Forbury Gardens in Reading, Berkshire Reading , until it moved in 1952 to Sulhamstead House then called the White House , purchased by the Berkshire Country Council five years earlier for 53,000. The house is currently the Thames Valley Police Training College and Thames Valley Police Museum . Berkshire was amalgamated with several other smaller forces during its existence, including the Abingdon Borough Police, Maidenhead Borough Council, Newbury Borough Police, Wallingford Borough Police and Wantage Borough Police. The Windsor Borough Police remained an independent force, due to the Royal presence at Windsor Castle , until it merged with Berkshire in 1947. It was created on 16 November 1968, as a merger of the Inverness Burgh Police and the Inverness shire Constabulary . Inverness Constabulary merged with the Northern Constabulary and the Ross and Sutherland Constabulary on 16 May 1975, as part of the creation of the Local government areas of Scotland 1973 to 1996 regions of Scotland .
