    Image James Balfour of Denmyine and Kinnaird.jpg right thumb 200px Sir James Balfour, 1st Baronet There have been three Baronetcies created for persons with the surname Balfour , one in the Baronetage of Nova Scotia and two in the Baronetage of the United Kingdom . The Balfour Baronetcy , of Denmiln and Kinnaird in the County of Fife, was created in the Baronetage of Nova Scotia on 22 December 1633 for James Balfour of Denmylne. He was Lord Lyon King of Arms from 1630 to 1654. The line of the first Baronet failed on the early death of his son, the second Baronet, in 1673. The late Baronet was succeeded by his uncle, the third Baronet. The title then descended from father to son until the death of the latter s great great grandson, the seventh Baronet, in 1773. He was succeeded by his younger brother, the eighth Baronet. When he died in 1793 the baronetcy became dormant. It held that there is a rebuttable presumption against an intention to create a legally enforceable agreement when the agreement is domestic in nature. Facts Mr Balfour was a civil engineer, and worked for the Government as the Director of Irrigation in Ceylon now Sri Lanka . Mrs Balfour was living with him. In 1915, they both came back to England during Mr Balfour s leave. But Mrs Balfour got Rheumatism rheumatic arthritis . Her doctor advised her to stay, because a jungle climate was not conducive to her health. As Mr Balfour s boat was about to set sail, he promised her 30 a month until she came back to Ceylon. They drifted apart, and Mr Balfour wrote saying it was better that they remain apart. In March 1918, Mrs Balfour sued him to keep up with the monthly 30 payments. In July she got a decree nisi and in December she obtained an order for alimony . At first instance, Sargant J held that Mr Balfour was under an obligation to support his wife. Judgment The Court of appeal unanimously held that there was no enforceable agreement, although the depth of their reasoning differed. Warrington LJ delivered his opinion first, the core part being this passage.     David A. Balfour 1889 1956 was a municipal politician in Toronto , Canada . He was active in civic politics from 1939 until 1955. This included twelve years on the Toronto Board of Control Board of Control , a longer service than anyone prior. Balfour was born in Amherstburg, Ontario . His father was MPP and later Speaker of the Legislative Assembly of Ontario William Balfour . Balfour joined his father in Toronto at age seven and was educated at De La Salle College Toronto De La Salle College . He went into business owning a stationary supply store and became active on the Separate School Board, serving there fifteen years. He was first elected to city council in 1939. Throughout his political career Balfour was strongly identified as representing the city s Roman Catholic population. There were then few Catholic elected officials in Toronto as municipal politics was dominated by those affiliated with the Protestant Orange Order . One of Balfour s main issues was anti communism .
