Passing of the initiative would have made two changes to California law Eminent domain could not be used by government except to provide facilities for public use, to abate specific public nuisances, and to act in a declared state of emergency. This was a reaction to the Supreme Court of the United States Supreme Court s decision in Kelo v. City of New London . Government would be required to reimburse property owners whose property value is decreased as a result of any government regulation or action.   1. Acting Conservator of the River Mersey

    The Acting Conservator of the River Mersey is a unique position. The holder is responsible for ensuring navigation on, and protecting the Environmental science environment of, the River Mersey in the North West of England. The Conservator originally acted on behalf of a Commission appointed by The Crown , but now acts for the Department for Transport . History In order to maintain navigation on the Mersey the then town of Liverpool was granted a Charter by Charles I of England Charles I in 1626. This conferred the right to levy tolls for shipping and to carry out improvements to the navigation of the river. By the 1800s the Mersey was carrying shipping to a much larger area of North West England for example, it was possible to navigate to Manchester by 1730 and the Corporation of Liverpool believed it needed additional powers to fulfil its role. However, other groups did not see it in their interest to allow any one town to dominate development and the creation of a post for an independent expert, the Conservator was proposed. This position was created by 1842, and the Acting Conservator was responsible to a newly created Commission for Mersey Conservancy , whose members were appointed by the Crown.     Orphan date December 2009 Bedard v. Dawson , 1923 S.C.R. 681 is a leading constitutional decision of the Supreme Court of Canada . The Court held that the provinces could legislate in matters related to the prevention of crime even though the federal government had exclusive power over criminal law. The law was passed by the Quebec legislature and allowed for private citizens to apply to the Court to close down a premises if it was being used as a disorderly house. The Court upheld a provincial Act on the grounds that the law was in relation to property and civil rights and not criminal matters as was the case for an equivalent provision in the criminal code regarding disorderly houses . Justice Idington, writing for the majority, held that Indeed, the duty to protect neighbouring property owners in such cases as are involved in this question before us renders the question hardly arguable. There are many instances of other nuisances which can be better rectified by local legislation within the power of the legislatures over property and civil rights than by designating them crimes and leaving them to be dealt with by Parliament as such. p. 684 In a concurring opinion, Justice Anglin added I am of the opinion that this statute in no way impinges on the domain of the criminal law but is concerned exclusively with the control and enjoyment of property and the safeguarding of the community from the consequences of an illegal and injurious use being made of it a pure matter of civil right. For the band from Fort Worth, Texas see Green River Ordinance band The name Green River Ordinance is given to a common United States city ordinance prohibiting door to door solicitation. Under such an ordinance, it is illegal for any business to sell their items door to door without express permission from the household beforehand. Some versions prohibit all organizations, including non profit charitable, political, and religious groups, from soliciting or canvassing any household that makes it clear, in writing, that it does not want such solicitations generally with a No Trespassing or No Solicitations sign posted.     Orphan date October 2008 The Lake Perry Trail is a convert 29 mi km adj on trail located in the Northeastern section of Kansas by Lake Perry . This trail is commonly referred to as the Old Military Trail because it was created by the U.S. Army Corps of Engineers . Hiking Although the trail is maintained regularly some sections of the trail may be covered with underbrush and or mowed away as the trail crosses uncommonly used sections and fields. The popular season for hiking the Lake Perry Trail is from June until late August. From April until September hiking along portions of the trail become difficult as the amount of spider webs and ticks increase with the humid climate. Proper preparations and equipment is suggest to ward off these nuisances. Four miles of the trail are along dirt roads. These roads connect two sections of the trail together. Camping Camping is not allowed along the trail. However, there are campsites in two designated campgrounds along the trail. The Old Military Trail Campground and the Slough Creek and Longview Park areas provide adequate camping for the amount of hikers that trek annually. Wildlife Bald eagles , hawks , deer , wild turkey and other small mammals all make Lake Perry their home during parts of the year. Wild animals are seen from the trail frequently. After Lord Dumore s proclamation of freedom to any slave that helped the British Army, Henry Washington ran away from the Washington plantation to join the Black Pioneers in 1776. After the Black Pioneers arrived in New York in 1783 many former slaves escaped from the harbor in fear of being repossessed by their former masters. It is still unknown how many former slaves escaped from New York during this period, although it is known that after the evacuation of the British approximately 15,000 African American s were involved.     orphan date December 2008 Canterbury Hall, New York City was an edifice located at 663 Broadway Manhattan in the 19th Century. It was used for entertainment and political meetings. It was a three story building where bawdy concerts took place. The building had a front of forty feet and a depth of one hundred twenty five feet. Often called Mozart Hall, it was also a gathering place of anti Tammany Hall political forces in New York City . The edifice burned entirely in the early morning hours of March 24, 1861. ref name burned Proceedings at the venue were frowned upon by newspaper writers such as one from the New York Times . He commented about Canterbury Hall advertisements promoting the prettiest waiter girls in town . Along with a rival theater, the Melodeon, the establishment was a nightly disgrace to Broadway and its adjacent streets. In November 1860 the proprietors of the business, Fox & Curran, were compelled to pay a license fee of 500 to keep the venue open. A New York Times editorialist expressed the opinion that this was a first measure in ridding the city of such nuisances , which he predicted the New York State Legislature would soon entirely eliminate. ref Amusements , New York Times, November 16, 1860, pg. 5. ref The property on which Canterbury Hall stood was formerly owned by a Reverend Wiley. His estate encompassed additional buildings on Broadway and was insured for 15,000. The fire which consumed the structure began among stage scenery and was discovered by watchmen.     unreferenced date November 2008 The Metropolitan Police Act 1839 2&3 Vict. c .47 was an Act of Parliament passed by the Parliament of the United Kingdom . The Act enlarged the district of, and gave greatly increased powers to the Metropolitan Police established by the Metropolitan Police Act 1829 . Section 2 of the Act allowed for the enlargement of the Metropolitan Police District to include places in a radius of 15 miles 24 kilometres from Charing Cross . Section 5 gave constables of the Metropolitan Police all powers and privileges of constabulary in the counties of Berkshire and Buckinghamshire and on the River Thames within or adjoining Middlesex , Surrey , Berkshire , Essex , Kent and the City of London the MPA 1829 had already given them constabulary powers within Middlesex, Surrey, Essex and Kent . The Act gave the police force powers over shipping arriving in the Port of London and using the Thames. Among these powers were Power to inspect vessels to prevent smuggling Power to seize unlawful quantities of gunpowder Powers to seize guns loaded with ball A number of activities were to regulated within the Metropolitan Police District Fairs were only to be open during agreed hours. Public Houses were to closed on Sundays, Christmas Day and on Good Friday until 1 pm. No alcoholic drink was to be sold to persons under 16 years of age. Police were empowered to enter unlicenced theatres. Police could enter premises where bear baiting or cock fighting were being carried on, and fine the participants five pounds. Police were allowed to enter gaming houses. Regulations could be made to prevent the obstruction of parades and processions. Section 54 of the Act enumerated a long list of Nuisances by Persons in Thoroughfares that were now prohibited. Co. location St. Paul, Minn. isbn 978 0314211507 ref The case involves the owner of a livestock feedlot , Spur Industries, and Del Webb Webb Development , the developer of the now well known retirement community, Sun City, Arizona . Both enterprises beginning small, they eventually grew large and close enough to one another that the stench of manure and the infestation of flies from the feedlot were affecting both current residents of Sun City, and inhibiting future sales. Webb brought suit for an injunction against the further operation of the feedlot. The lower court granted the injunction, ordering Spur to shut down operations. The court held that the injunction was proper. Distinguishing between private and public nuisances, the former being remedied often only by damages, at least where the costs of injunction are great on the defendant, the court determined that the feedlot was a public nuisance. This decision was made in large part because an Arizona statute called any place in populous areas which constitutes a breeding place for flies . . . and other animals that can carry disease is a public nuisance. Determining south Sun City to be a populous area the court said that injunction was thus proper. Given the equities the court crafted a special injunction, however.     Cleanup rewrite date February 2011 Henry Fell Floruit fl. 1672 , was a Quaker missionary and writer. Fell was a member of one of the numerous Lancashire families bearing his surname. The first mention of him is in 1656 as suffering much from the magistrates in Essex , and in the same year he went as a missionary to the West Indies , where he remained about a year. After his return to England he was engaged as a travelling preacher, and is referred to by his contemporaries as having been eloquent and successful. In 1659 he was seriously ill treated by some soldiers near Westminster Hall , and in 1660 Richard Hubberthorne , the quaker, represented to Charles II of England Charles II that at Thetford, Norfolk , Fell had been hauled out of a meeting, and, after being whipped, turned out of the town, and passed as a vagabond from parish to parish to Lancashire. In a letter to Margaret Fell Swarthmore MSS. Fell states that he was imprisoned for some time at Thetford. He was in London during the rising of the Fifth Monarchists Fifth monarchy men in this year, and was knocked down by the soldiers as a rioter, and Fox Journal, p. 314, ed. 1765 says he would have been killed but for the interposition of the Duke of York. In 1661 he was moved, in company with John Stubbs , to promulgate his views in foreign parts, especially to Prester John s country and China. As no shipmasters would carry them, the quakers got a warrant from the king, which the East India Company found means to avoid. They then went to Holland, and, being unable to obtain shipping there, proceeded to Alexandria . The English consul banished them from the place as nuisances, and they were compelled to return to England. After spending some time in religious journeys, he again visited the West Indies, and a letter in the Shackleton collection states that in 1672 he was living in Barbados , that he was married, in debt, and much depressed.
