Orphan date February 2009 Scott v. Bradford , 606 P.2d 554 1979 is a Supreme Court of Oklahoma case. Facts Mrs. Scott, the plaintiff, sought treatment from Dr. Bradford. She was diagnosed with several fibroid tumors on her uterus. She signed a routine consent to surgery form prior to the hysterectomy . Afterward she was experiencing problems with Urinary incontinence incontinence , and she visited another doctor. She was found to have a condition which allowed urine to leak from her bladder into her vagina. She underwent three additional surgeries to correct her problem. Reasoning The duty to disclose is the first element. Then proof that patient would have chosen no treatment or a different course of treatment had the alternatives and risks been made known, thus establishing a causation. If the patient would have elected to proceed the element of causation is missing, and so too negligence. A causal connection between the patient s injury and the doctor s breach of a duty to disclose exists only when the disclosure of material risks would have resulted in a decision against it. The final element is that of an injury. The risk must have actually materialized, AND pl must have been injured as a result of submitting to the treatment. Notes Exception to the Duty to disclose There is no need to disclose risks that either ought to be known by everyone or are already known to the patient or if the disclosure would alarm an emotionally upset patient or where there is an emergency and the patient is in no condition to determine for himself whether the treatment should be administered. Criminal procedure trial Brady material consists of Exculpatory evidence exculpatory or impeaching information and evidence that is material to the guilt or innocence or to the punishment of a defendant. The term comes from the U.S. Supreme Court case, Brady v. Maryland , ref 373 U.S. 83 1963 ref in which the Supreme Court ruled that suppression by the prosecution of evidence favorable to a defendant who has requested it violates due process . Following Brady , the prosecutor must disclose evidence or information that would prove the innocence of the defendant or would enable the defense to more effectively impeach the credibility of government witnesses. Evidence that would serve to reduce the defendant s sentence must also be disclosed by the prosecution. Examples The prosecutor must disclose an agreement not to prosecute a witness in exchange for the witness s testimony. ref Giglio v. U.S. , 405 U.S. 150 1972 . ref The prosecutor must disclose leniency or preferential treatment agreements made with witnesses in exchange for testimony. ref U.S. v. Sudikoff , 36 F.Supp. 2d 1196 C.D. Cal. 1999 State v. Lindsey , 621 So. 2d 618 La. Ct. App. 1993 . ref The prosecutor must disclose exculpatory evidence known only to the police. That is, the prosecutor has a duty to reach out to the police and establish regular procedures by which the police must inform him of anything that tends to prove the innocence of the defendant. ref Kyles v. Whitley , 514 U.S. 419 1995 . ref However, the prosecutor is not obligated to personally review police files in search of exculpatory information when the defendant asks for it. ref U.S. v. Herring , 83 F.3d 1120 9th Cir. 1996 . ref The prosecutor must disclose arrest photographs of the defendant when those photos do not match the victim s description. ref Commonwealth v. Evidence law Exculpatory evidence is the evidence law evidence favorable to the defendant in a criminal law criminal trial , which clears or tends to clear the defendant of guilt . ref http legal dictionary.thefreedictionary.com Exculpatory evidence The Free Dictionary by Farlex Definition of Exculpatory evidence ref It is the opposite of inculpatory evidence , which tends to prove guilt. In many countries such as the United States , police or prosecutor are not required to disclose to the defendant any exculpatory evidence they possess before the defendant makes a plea guilty or not guilty . ref Quote from Prof. Laurie Levenson Prof. SCHECK ... that didn t commit the crime. But I think the problem is that under the law now, number one, prosecutors are not obligated to provide exculpatory evidence to grand juries who are considering whether or not to indict a defendant. And number two, there s no real requirement at all that prosecutors disclose exculpatory evidence to defendants prior to the time they decide to plead. http www.npr.org templates story story.php?storyId 122286337 ref Per the Brady v. Maryland decision, prosecutors have a duty to disclose exculpatory evidence even if not requested. Though it is true that the prosecution is not required to search for exculpatory evidence and must only disclose the evidence it has in its possession, custody or control, the prosecution s duty to disclose includes all information known to any member of its team, e.g., police, investigators, crime lab, etc. In Brady v. Maryland , the U.S. Supreme Court held that such a requirement follows from constitutional due process and is consistent with the prosecutor s duty to seek justice. ref cite book title Criminal Law And Procedure For The Paralegal A Systems Approach author James W. Under common law , public interest privilege prevents the compulsory disclosure of documents or information which is against the public interest. There is a balance between public interests if the public interest in secrecy is greater than the public interest in disclosure, it will be privileged. The public interest in disclosure is the principle that a court of justice ought not be denied access to relevant information, and that the opposing party should have access to all relevant information to make their case. ref Sankey v Whitlam 1978 142 CLR 1 at 39 ref Unlike other privileges, this right is not vested in any party or entity. The court may, of its own motion, prevent admission of evidence if it thinks it may disclose privileged information. The government need not be a party to proceedings for privilege to be raised. ref Sankey at 44 ref Privilege, being vested in the public interest and not a party, cannot be waived by a party. However, if the information has been published elsewhere this is a very strong factor towards the public interest of disclosure. ref Sankey at 45 ref This privilege may be claimed on two bases. Firstly, that the documents belong to a class of documents which the public interest requires should not be disclosed. In Australia , even for documents belonging to a very high level documents, such as cabinet papers, the court must interrogate whether it really is prejudicial to the public interest to disclose it. ref Sankey ref Australian judges in general have been more willing to disclose information than judges in England or Canada . ref Suzanne McNicol, Law of Privilege 1st ed, 1992 at 410 ref See also Privilege in general State Secrets Privilege , the United States equivalent Notes references law stub Category Evidence law ... more details
