  1. Patent caveat

A patent caveat was a legal document filed with the United States Patent and Trademark Office United States Patent Office . ref Patent Act of 1836 ref Caveats were instituted by the US Patent Act of 1836 , but were discontinued in 1909. A caveat was like a patent application with a description of an invention and patent drawing drawing s, but without claim patent claim s. It was an official notice of intention to file a patent application at a later date. A caveat expired after one year, but was renewable by paying an annual renewal fee . The filing fee for a caveat was much less costly than the filing fee for a patent application and did not entail an additional lawyer s fee for drafting claims. Caveats were similar to provisional application s used today in the United States Patent and Trademark Office which also expire after one year. However, provisional applications are not now renewable under any circumstances. According to the Guide to the Practice of the Patent Office 1853, ref quoted in The Telephone Patent Conspiracy of 1876 by A. E. Evenson, page 66 ref the primary objective of a caveat was to prevent the issuing of a rival patent for the same invention to a subsequent inventor. Before the issuing of a patent, the caveats filed within the preceding year were searched. If one was found for the same invention as the proposed patent, the Patent Office notified the holder of the caveat, who then had three months to submit a formal patent application with claims. 1. Paulette Caveat

Indigenous Peoples of Canada In 1973, a group of Dene chiefs filed a caveat at the land titles office in Yellowknife, Northwest Territories Yellowknife , Northwest Territories to gain a legal interest in convert 400000 sqmi km2 of land in northern Canada . The chiefs wanted to claim the land by virtue of their aboriginal rights, and prevent further development until ownership had been settled. It came to be known as the Paulette Caveat, named after Fran ois Paulette , who was chief of the Fort Smith Chipewyan at the time, and one of the chiefs who initiated the caveat. If the caveat was allowed, all development in the area could be halted until land claims were settled. The land office referred the caveat to the Supreme Court of the Northwest Territories and Justice William Morrow , the only sitting judge of that court at the time. Morrow held a six week hearing process in several communities in the Northwest Territories, some only accessible by plane. He wanted to find out if aboriginal people had understood that they were signing over their land to the government, when they signed Treaty 8 and Treaty 11, several decades earlier. Morrow listened to testimony from elderly people in the communities who witnessed the signing of land treaties decades earlier. Morrow even held his court at the bedside of elderly people unable to make it to the makeshift courtrooms. Many witnesses testified that the people who signed the treaties were under the impression that they were committing to a peace and friendship deal with the Canadian government and the white man. Morrow found that the Dene did not understand the treaties to have relinquished their traditional rights to the land. He ruled that the chiefs had sufficiently established a case for claiming aboriginal rights so as to warrant the filing of a caveat. The finding was appealed by the federal government and later overturned by the Supreme Court of Canada , but only on a point of law. The higher court didn t question Morrow ...   more details

  1. Seixas v. Woods

Seixas v. Woods ref http books.google.com books?id K8UDAAAAQAAJ&dq Seixas 20v. 20Woods&lr &pg RA2 PA47 IA1&output text text ref Case citation 2 Cai. R. 48 ref 2 Cai. R. 48 is an abbreviation for volume 2 of Caines Reports, page 48, which was in turn named for George Caines , who reported New York cases in the early 19th century. ref N.Y. Sup. Ct. 1804 was an 1804 American case which contributed to precedent around the doctrine of caveat emptor . Summary The following summary comes from an open source published in 1884 In Seixas v. Woods 1804 , a contract was made for the delivery of braziletto wood, and it was so advertised and described in the invoice. A delivery was made of an article known as peachum wood, much inferior in quality. There was no evidence of fraud or an express warranty, and it was held that an action on the case would not lie, for selling one wood for the other. Kent, Chancellor, said If upon a sale there be neither warranty nor deceit, the purchaser purchases at his peril. . . . The mentioning the wood as braziletto wood in the bill of parcels, and in the advertisement some days previous to the sale, did not amount to a warranty to the plaintiffs. To make an affirmation at the time of the sale a warranty, it must appear by the evidence to be so intended, and not to have been a mere matter of judgment or opinion, and of which the defendant had no particular knowledge. Here it is admitted the defendant was equally ignorant with the plaintiffs, and could have had no such intention. ref http books.google.com books?id mVg9AAAAIAAJ&dq Seixas 20v. 20Woods&pg PA93&output text summary ref Significance Seixas v. Wood relies heavily on the English case of Chandelor v Lopus , and is the American counterpart to Chandelor in developing the rule caveat emptor . Laidlaw v. Organ , an 1817 decision by Chief Justice John Marshall , is believed to have been the first U.S. Supreme Court case which laid down the rule of caveat emptor. ref http emoglen.law.columbia.ed ...   more details

Orphan date April 2010 A lay scholar is a person who acts as a scholar but without the training or degree that normally goes with it. This can include such people as jailhouse lawyer s and some Wikipedian s, who offer their knowledge to others in a forum in which it is generally understood by the recipients that the principle of caveat emptor applies. Such customers may rely on the expertise of lay scholars because it is less expensive or the only alternative available. Some lay scholars are able to build a reputation of knowledge that allows them to obtain positions of authority normally reserved for the formally trained. ref citation url http www.encyclopedia.com doc 1P1 121630260.html title Conservative Judaism s prime seminary in U.S. taps a lay scholar as new leader date April 10, 2006 publisher Associated Press author Ostling, Richard N. ref References Reflist Category Academia ...   more details

It stands for the distinction between warranties and mere affirmations and announced the rule of caveat emptor buyer beware . Facts A man paid 100 for what he thought was a bezoar stone. This is a stone that forms in animals intestinal systems, and was believed to have magical healing properties. The seller said he thought it was a bezoar stone, but he also made clear that he could not be totally certain that it was. The buyer sued for the return of the 100 purchase price. How the claimant discovered that the bezoar did not work is not discussed in the report. Judgment The Exchequer Court held the buyer had no right to his money back, saying the bare affirmation that it was a bezoar stone, without warranting it to be so, is no cause of action. Signficance Though scepticism over the alleged magic paranormal magical powers of bezoars may well have been justified, Chandelor long stood as an impediment to any common law development of consumer protection remedies. Only in the nineteenth century did the law begin to evolve a doctrine of implied warranty . See also Cross v Gardner 1689 Cart. 90, Lord Holt CJ held that An affirmation at the time of a sale is a warranty, provided it appears on evidence to be so intended.
