It will stand in a prominent location on Bishopsgate , just a short walk from Liverpool Street station . The developer is Great Portland Estates , the architect is Allies and Morrison and the Structural Engineer is Robert Bird Group . It has been planned for several years now, and was initially rumoured to be 260  m 55 storeys. However, a planning application submitted in September 2006 revealed it to be 165  m, with 40 storeys. It was approved in April 2007, however, demolition of the building currently on the site is under way. In July 2011 It was given a 7m height increase taking the overall height to 172m The building will contain convert 785772 sqft m2 2 of office floorspace. It will stand on the other side of Camomile Street to the Heron Tower , another skyscraper.     Unreferenced stub date December 2009 The Bishopsgate mutiny occurred in April 1649 when soldiers of Colonel Edward Whalley s regiment of the New Model Army refused to obey orders and leave London. At the end of the mutiny one soldier, a supporter of the Levellers , Robert Lockyer , was executed by firing squad. In January 1649 Charles I of England was tried and executed for treason against the people. In February the Grandee New Model Army Grandee s senior officers banned petitions to Parliament by soldiers. In March eight Leveller troopers went to the Commander in Chief of the New Model Army, Lord Thomas Fairfax, 3rd Lord Fairfax of Cameron Thomas Fairfax , and demand the restoration of the right to petition. Five of them were cashiered out of the army. 300 infantrymen of Colonel John Hewson regicide John Hewson s regiment, who declared that they would not serve in Ireland until the Leveller programme had been realised, were cashiered without arrears of pay, which was the threat that had been used to quell the Corkbush Field mutiny . When Soldiers of the regiment of Colonel Edward Whalley stationed in Bishopsgate London made similar demands they were ordered out of London. They refused to go fearing that once outside the City of London they too would be given the choice of obey or be cashiered without arrears of pay. The mutineers surrendered after a personal appeal by Fairfax and Oliver Cromwell . Fifteen soldiers were arrested and court martialed, of whom six were sentenced to death. Five were pardoned but Robert Lockier, a former Agitator Levellers Agitator within the regiment, was executed by firing squad in front of St Paul s Cathedral on April 27, 1649. This case is an example of what would now be CA 2006 s 171. Facts Robert Maxwell , who controlled Maxwell Group plc and bought the Daily Mirror in 1984, fell off his yacht in the Canary Islands on 5 November 1991. It transpired he had used the company pension funds to fund his own lifestyle. Ian Maxwell was Robert s son and a director of Bishopsgate Investment Management Ltd, which was meant to be safeguarding the company pension plans. He had signed share transfers from Bishopsgate to Maxwell Group plc for no Consideration in English law consideration . The shares had been held on trust for a number of pension schemes. The liquidators of Bishopsgate sued Ian Maxwell to compensate for the value of the shares, on the basis that it was an improper use of the company s property. Judgment Hoffmann LJ held that Ian Maxwell was liable for the value of the shares, not even on the basis of any negligence, but merely by misapplying the assets. ref This would now fall under CA 2006 s 171. ref Cquote In the older cases the duty of a director to participate in the management of a company is stated in very undemanding terms.     Macmillan Inc v Bishopsgate Investment Trust plc No 3 1996 WLR 387 is an English trusts law case from the Court of Appeal. Facts A claimant company sought the return of shares it owned in another company which its controller, Robert Maxwell , had fraudulently pledged to a third party. Judgment The Court of Appeal rejected the claimant company s argument that the question should be classified as restitutionary, and instead categorised the issue as on of trust law breach of trust , and determined the choice of law issues accordingly. It emphasised that it was not the claim but the issue which fell to be characterised. In the instant case this issue concerned title to intangible movable property and was thus governed by the lex situs of the shares, whose application the claimant company was trying to avoid. The Court also addressed the question of where the lex situs situs of stock shares issued by a company is under the English conflict of laws . Sadly, the three judges all of whom gave reasoned judgments appeared to take different approaches a majority seemed to be in favour of the historical rule preferred by Dicey & Morris that shares should be deemed to be located where they can be dealt with, which in the case of registered shares will normally be the place of the share register but there also appeared to be some support for the alternative line of authority in certain Canadian cases that the shares should be deemed to located in the jurisdiction where the company was incorporated. On the facts of the case both were New York the state of New York , and so the decision made little practical difference. The Court also confirmed that bearer security bearer securities are considered to be located in the place where the certificate is physically present under English law.
