The Confiscation Acts were laws passed by the United States Congress during the American Civil War Civil War with the intention of freeing the American slavery slaves still held by the Confederate States of America Confederate forces in the South. The First Confiscation Act of 1861 authorized the confiscation of any Confederate property by Union American Civil War Union forces property included slaves . This meant that all slaves that fought or worked for the Confederate military were freed whenever they were confiscated by Union troops. It stated that any Confederate official, military or civilian, who did not surrender within 60 days of the act s passage would have their slaves freed. However, this act was only applicable to Confederate areas that had already been occupied by the Union Army. All slaves that took refuge in Union areas were captives of war and would be set free. U.S. President Abraham Lincoln opposed these acts, believing that they would push the Border states Civil War border states towards siding with the Confederacy, he nonetheless signed them to make them law. The growing movement towards emancipation was aided by these acts, which eventually led to the Emancipation Proclamation in 1863 . Ch. 153 USStat 14 428 , March 23, 1867 40 Cong. Ch. 6 USStat 15 2 , July 19, 1867 40 Cong. Ch. 30 USStat 15 14 , March 11, 1868 ch. 25, USStat 15 41 . Fulfillment of the requirements of the Acts were necessary for the former Confederate States of America Confederate States to be readmitted to the Union. The Acts excluded Tennessee, which had already ratified the Fourteenth Amendment to the United States Constitution and had been readmitted to the Union. A key feature of the Acts included the creation of five military districts, each commanded by a general, which would serve as the acting government for the region. In addition, Congress required that each state draft a new state constitution, which would have to be approved by Congress. The states also were required to ratify the Fourteenth Amendment and grant voting rights to black men. President Andrew Johnson s vetoes of these measures were overridden by Congress. After Ex Parte McCardle 1867 came before the Supreme Court, Congress feared that the Court might strike the Reconstruction Acts down as unconstitutional. To prevent this, Congress repealed the Habeas Corpus Act of 1867 , revoking to the Supreme Court s jurisdiction over the case.
